These Terms of Service (the "Terms") form a binding agreement between you and VioletNexus ("VioletNexus," "we," "us," or "our") and govern your use of our modular business platform, websites, and related services (collectively, the "Service").
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization. If you do not agree, do not use the Service.
2. The Service
The Service provides modular tools to build a business website and operate the business behind it, including customer management, commerce, payments, scheduling, and automation. We may add, modify, or discontinue features over time. We will use reasonable efforts to provide continuity of the Service but do not guarantee uninterrupted availability.
3. Accounts & Eligibility
You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use. The Service is intended for business use by individuals who can form a binding contract.
4. Acceptable Use
You agree not to misuse the Service, including by attempting to access it in unauthorized ways, interfering with its operation, violating the rights of others, uploading unlawful or infringing content, or using the Service to send unsolicited communications. We may suspend or limit access to protect the Service and its users.
5. Your Content & Data
You retain ownership of the content and data you submit to the Service. You grant us a limited license to host, process, and display that content solely to provide and improve the Service. You are responsible for having the necessary rights to your content and for its compliance with applicable law.
6. Fees & Billing
Paid plans are billed according to the pricing and billing terms presented at purchase. Fees are non-refundable except as required by law or as expressly stated. We may change pricing prospectively with reasonable notice. You are responsible for applicable taxes.
7. Third-Party Services
The Service may integrate with third-party services such as payment processors, email providers, and analytics tools. Your use of those services is governed by their own terms, and we are not responsible for their acts or omissions.
8. Intellectual Property
The Service, including its software, design, and trademarks, is owned by VioletNexus or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding except as necessary to use the Service.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, VioletNexus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Service. Our aggregate liability for any claim will not exceed the amounts you paid for the Service in the twelve months before the event giving rise to the claim.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or comply with law. Upon termination, your right to use the Service ceases, and we will handle your data as described in our Privacy Policy and any applicable data retention practices.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
